GroupBuy Terms & Conditions

1. Acceptance of Agreement
This Agreement is between you and Ecobeam Solutions Limited ("Company", "we", "us", or "our"), governing your use of the GroupBuy mobile application and website ("Service"). By creating an account or using the Service, you signify your irrevocable acceptance of these Terms & Conditions and the Privacy Policy & Data Protection Notice.
2. Eligibility & Registration
Age Requirement: You must be at least 18 years of age to use GroupBuy. We enforce a strict 18+ policy to comply with commercial and data protection laws in Kenya.
Verification: During registration, you must provide your legal first name, second name, date of birth (DOB), and a valid Kenyan phone number. We perform server-side age validation based on your DOB. Providing false information is a material breach of these terms.
Email & Identity: Accounts created via email/password require mandatory email verification. Accounts created via Google Sign-In must complete the GroupBuy onboarding process before accessing marketplace functionality.
3. Marketplace & Group Buy Mechanics
Product Listings: All products are controlled and listed by GroupBuy. While we use AI-assisted tools for catalog management, final listings are authoritative.
MOQ Model: GroupBuy operates on a Minimum Order Quantity (MOQ) model. A "Deal" is an offer to purchase a product at a wholesale price contingent on a specific number of units being reserved by the community.
Joining a Deal: By joining a deal, you are making a non-binding reservation indicating your intent to purchase. Pricing displayed at this stage is provisional.
Deal Activation: A deal only activates once the MOQ is met. Upon activation, the provisional price is confirmed, and participants are notified to complete their payment.
4. Payments & Financial Integrity
Payments are processed exclusively via Safaricom M-Pesa (STK Push). All transactions undergo independent backend verification. We use cryptographic receipt uniqueness and idempotency controls to prevent double-billing and fraud. You may not attempt to manipulate order amounts or payment statuses; such attempts will result in immediate account termination and reporting to authorities.
5. Fulfillment, Refunds & Defective Goods
- Delivery: Estimated arrival dates are projections. We communicate shipping updates (Shipping, Arrived, Ready for Collection) via the Service.
- Cancellations: Users may leave a deal freely before it reaches MOQ. Once a deal is activated and payment is initiated, cancellations are subject to our approval.
- Defective Goods: We provide protections for goods that arrive damaged or significantly not as described. Claims must be filed at the collection point or within 24 hours of pickup.
- Anti-Fraud: We employ anti-refund-fraud controls to maintain the integrity of group purchases.
6. Data & AI Use
We use Google Cloud and Firebase infrastructure for international data processing. We utilize Gemini AI for product analysis, search matched-analytics, and inventory suggestions. These tools process aggregated data to improve the Service for all users.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nairobi.
